Not long after &lt;a href="www.ohioccw.org"&gt;Ohioans for Concealed Carry&lt;/a&gt; brought the case publicity and began to raise funds for Mr. Bartlett's defense did the City Council President publicly make his anti-gun bias known. &lt;a href="www.ohioccw.org"&gt;Ohioans for Concealed Carry&lt;/a&gt; quickly went into action and invited the City Councilman to attend a shooting event with former Ohio Governor Strickland. The City Councilman has since taken a much different tune and we, as &lt;a href="www.barneydebrosse.com"&gt;gun owners&lt;/a&gt;, applaud him for his reasonableness. &lt;br /&gt;&lt;br /&gt;Mr. Bartlett's case, however, unbelievably was still prosecuted in the City of Canton while Officer Harless was placed on paid leave pending a disciplinary hearing. At trial the judge dismissed the gun charges against Mr. Bartlett in a clear victory for concealed carry holders across Ohio. &lt;br /&gt;&lt;br /&gt;I am pleased to announce that as of this week Officer Harless will no longer be a threat to gun owners' rights here in Ohio. The case has been eyed closely by 2nd Amendment groups across the nation and has drawn nearly 1 million views on youtube (video below). Mr. Bartlett was accused of failing to notify a law enforcement officer that he was armed and a CHL holder. The evidence (see below) clearly shows otherwise and also shows why the law needs to be changed. Today a Criminal Rule 29 motion was made and granted at the close of evidence. The decision was so clearly obvious that the court simply dismissed the charges against Mr. Bartlett. It is wholly unacceptable that our elected officials are prosecuting people under such circumstances. I never liked the M9 - from the first time I ever shot one I thought it was an inferior weapon. I was once told that the reason why we ever went to the M9 was to ensure that Italy would allow the US Military to maintain a base in their country (The M9 being manufactured in Italy). &lt;br /&gt;&lt;br /&gt;As I was reading through yet another fantastic issue of Army Times today the headline reads "Army dumping M9". All I have to say is it is about time. My suggestion for the army is to go to the Glock .40 cal model 23. Schulman clearly has no resepct for our civil rights and blames the incident on the fact that a law abiding citizen wanted to ensure he was protected. &lt;a href="www.ohioccw.org"&gt;Ohioans For Concealed Carry&lt;/a&gt; has called for both Officer Harless and President Schulman's resignation. From what can be seen on the video it appears the Canton PD has violated the victim's Constitutional rights on many levels. These bills are a huge achievement for the gun rights community in the State of Ohio. Now citizens will be able to protect themselves in establishments that serve alcohol. The bills also simplified motor vehicle carry doing away with some of the most restrictive criminal offenses regarding vehicle carry in the country. Ohio, 2010-Ohio-6318&lt;/span&gt;. The case originated when the City of Cleveland brought suit against the State of Ohio for its "pre-emption" statute under Revised Code 9.68 of Ohio law. The Ohio Supreme Court held that 9.68 is, in fact, constitutional and does not infringe on local municipality constitutional rights. The issue had already been decided in &lt;a href="http://www.ohioccw.org"&gt;Ohioans for Concealed Carry&lt;/a&gt; v. City of Clyde, yet the City of Cleveland decided to take the matter up once again. &lt;br /&gt;&lt;br /&gt;As &lt;a href="http://www.debrosselaw.com"&gt;general counsel&lt;/a&gt; for Ohioans for Concealed Carry &lt;a href="http://www.buckeyegunlaw.com"&gt;my office&lt;/a&gt; has been eagerly anticipating this decision. Brian Atkin was convicted in a NJ court for violating the state's firearm transportation provision - the Judge sentenced him to 7 years in prison. Governor of NJ, Chris Christie, granted Mr. Aitken's clemency application and now the case moves up the appeals ladder to vindicate Mr. Aitken's name. &lt;br /&gt;&lt;br /&gt;Ohioan's should also be aware of some of our state's more nuanced laws, especially those concerning the trasnportation of firearms in a motor vehicle. A fellow attorney recently sent to me the case of &lt;span style="font-style:italic;"&gt;State v. Marinko Thomas&lt;/span&gt;. &lt;a href="http://codes.ohio.gov/orc/2923.13"&gt;Ohio Revised Code 2923.13&lt;/a&gt; prohibits individuals in the State of Ohio from owning firearms if they have been convicted of ANY crime involving a drug of abuse. Historically this includes crimes from possession of small amount of marijuana to paraphernalia crimes. This has always caused great challenges for law enforcement officers and law abiding citizens who simply made bad decisions in their youth. Cuyahoga County Judge Brian Corrigan, however, ruled in the above case that the law is unconstitutional as it fails to serve a compelling governmental interest. Additionally, the Senate also passed SB 247 which brings state law into line with federal law on restoration of rights for gun owners. &lt;br /&gt;&lt;br /&gt;With elections looming it will be interesting to see what the Democratic party in Ohio (which got elected largely on a pro-gun stance) will do with these bills. Governor Strickland has already indicated a willingness to sign these bills but will not be able to do so unless they are placed in front of him. &lt;br /&gt;&lt;br /&gt;As an &lt;a href="http://www.buckeyegunlaw.com"&gt;Ohio Gun Lawyer&lt;/a&gt; I continue to work diligently on keeping apprised of all changes in our gun laws. Essentially a title II class III firearm is an item such as a silencer (commonly referred to as "cans"), machineguns and certain other novelty firearms. As a &lt;a href="http://www.buckeyegunlaw.com"&gt;Columbus Gun Lawyer&lt;/a&gt; I offer what is commonly referred to as a &lt;a href="http://www.buckeyegunlaw.com"&gt;Gun Trust&lt;/a&gt;. Essentially, the benefit of this type of trust is that it avoids fingerprints, photographs, the CLEO (Chief Law Enforcement Officer) authorization, and speeds the process up of obtaining the item. In certain communities the chief law enforcement officer refuses or places additional burdens on gaining their authorization which is required by federal law if an individual is purchasing the item. The gun trust avoids the CLEO. Moreover, the gun trust allows for the appropriate handling of the weapon through the estate at death, thereby avoiding any potential violations of federal law. The Democratic Party made a public records request pursuant to an Ohio law that allows "journalists" to gather such information for dissemination to the public alone. They were unsuccessful in their attempts and later rescinded the request after realizing they were not an eligible party to such information. The Senate passed SB 239 which allows for concealed carry licensees to carry concealed firearms into liquor establishments as long as they are not consuming alcohol. The bill also brings with it additional provisions which allow a licensee to carry a concealed firearm more readily in a motor vehicle. &lt;br /&gt;&lt;br /&gt;As an &lt;a href="www.buckeyegunlaw.com"&gt;Ohio Gun Attorney&lt;/a&gt; I have worked diligently with Ohioans for Concealed Carry to ensure the interests of Ohio gun owners are made known to our elected officials. Even with aggressive opposition to this legislation gun owners have united and made their voices heard. As a &lt;a href="www.buckeyegunlaw.com"&gt;Columbus Gun Lawyer&lt;/a&gt; it is always an honor to represent citizens who understand the necessity of preserving our 2nd Amendment rights. &lt;br /&gt;&lt;br /&gt;Additionally, the Senate also passed SB 247 which brings state law into line with federal law on restoration of rights for gun owners. &lt;br /&gt;&lt;br /&gt;Both of these bills are essential to alleviating the confusion that exists within the Ohio Weapons Control Act and brings state law not only in line with federal law but also with the majority of other states. Senate Bill 239 permits a concealed carry licensee to possess a firearm on premises that have class D liquor permits as long as they are not consuming alcohol or are intoxicated. This law would bring Ohio into line with a majority of other states that recognize concealed carry. The bill would also lessen restrictions on improperly handling firearms in a motor vehicle as applied to concealed carry laws. &lt;br /&gt;&lt;br /&gt;Local gun rights organizations and the NRA have been working diligently on seeking this change in the law for some time. The necessity for law abiding Ohioans to be able to protect themselves and their loved ones in locations that have class D liquor permits is an important one and one that gun owners in the state have anticipated for a long time. The turnout was great with more participants attending than anticipated given the recent blizzard like conditions. &lt;br /&gt;&lt;br /&gt;All of the speakers performed exceptionally. Mr. Fulkerson led the way with an hour seminar on the Ohio Weapons Control Act followed by Mr. John Litle who brought his experience as a Franklin County Assistant Prosecuting Attorney to the event.
